A New York court has refused to throw out AB InBev’s legal case against Constellation Brands, meaning that the two drinks titans remain at loggerheads over the definition of the term ‘beer’, The Drinks Business reported on November 7.

What is beer? It was defined as early as 1516 in Bavaria’s Reinheistsgebot, the famous purity law which classified it as a beverage produced solely from water, barley and yeast.

Since then every significant dictionary has provided its own description, and various national excise laws have further underpinned the definition of probably the world’s most popular brewed beverage.

But seemingly none is sufficiently specific to satisfy two of the world’s biggest drinks group, Anheuser Busch InBev, the Number one brewer, with a stock market value of around US$90 billion, and Constellation Brands, the leading US drinks producer, valued at US$45 billion.

The two are locked in what could become multi-billion dollar lawsuits over the use of the Corona and Modelo Mexican beer brand names in the US.

Brewery news Canada: Beer Canada disappointed by government’s Fall Economic Statement
Brewery trade organization Beer Canada has expressed its concern that the Fall Economic Statement 2022, released on November 3 by the Government of Canada, “fails to address the strong consensus recommendation from brewers, hospitality, tourism, and labour unions to freeze beer taxes in recognition of today’s challenges and the current unique business environment.”

“It is extremely disappointing and frustrating that [the] update has no measure to address next year’s looming federal tax increase on beer”, said CJ Hélie, President of Beer Canada, in a statement. “A further inflation-indexed tax hike on beer next year will impose unnecessary and willful harm on Canadian consumers, the hospitality sector and Canadian brewers of all sizes.”

Federal alcohol excise duties automatically increase each year on April 1st based on a Consumer Price Index (CPI) inflation-indexing formula determined the previous September. In 2023, these duties are set to increase by 6.3%, the largest jump since the formula was introduced in Budget 2017.

Brewery news USA, NY: Montauk Brewing Company acquired by leading cannabis company Tilray Brands
The leading cannabis company Tilray Brands, Inc. has expanded its United States footprint and acquired a popular beer brewery in Metro New York, the Mugglehead Magazine reported on November 7.

On November 7, the firm announced the acquisition of Montauk Brewing Company for an undisclosed amount which sells its products to retailers such as Target, Whole Foods, Trader Joe’s, Walmart, 7-Eleven, Costco among others.

The company aims to take advantage of its infrastructure, operations and brands across beer, spirits, and snack-food categories to move into THC-based products upon federal legalization.

Tilray says the addition of Montauk Brewing will strengthen its net revenue and adjusted earnings before interests, taxes and depreciation.

The company also owns the SweetWater Brewing Company which is one of the largest craft brewers in the United States. It also owns the Alpine and Green Flash iconic Southern California brands and the bourbon and spirits brand Breckenridge Distillery.

Tilray also created a new position overseeing brewery and beer operations in the country and appointed Ty H. Gilmore as president of its beer business segment. He was previously an executive vice president for Glazer’s Beer and Beverage where he oversaw operations across 11 distributors in the south.

Brewery news Canada, ON: Wave of consolidation in Ontario’s craft beer industry becoming a flood
The wave of consolidation in Ontario’s craft brewery industry is becoming a flood — and experts say repeated COVID lockdowns are only partly to blame, The Record reported on November 4.

In the last two weeks alone, two breweries have been bought, and two others have come together in a “strategic alliance” that will see them share sales, distribution, and some brewing operations.

A slump in draft sales during the global COVID-19 pandemic hit an industry that was already being flooded with new breweries, fickle consumers, and competition from prepackaged cocktails and hard seltzers, industry experts said.

Supply chain woes and increased ingredient costs have also hurt, said Todd Lewin, a board member at the Ontario Craft Brewers Association, and part owner of Muskoka Brewery.

“I think the craft industry was challenged going into the pandemic and the tough past two years just accelerated that,” said Lewin, whose brewery announced this week that it’s buying Rally Beer Co., a “functional beer” brand which had been brewed under contract at Toronto’s Brunswick Bierworks.

Brewery news USA, PA: Philadelphia’s first Black-owned brewery Two Locals Brewing Co. hopes to open own facility in summer 2023
Two Locals Brewing Co., Philadelphia’s first Black-owned brewery, has signed a lease for a brewery and taproom at uCity Square, a mixed-use development on the Drexel University campus at 37th and Market Streets in University City, the Philadelphia Inquirer reported on November 7.

Brothers Richard and Mengistu Koilor, whose beers are now being contract-brewed out of Mainstay Independent Brewing in Northern Liberties, hope to open in summer 2023.

The Koilors are working with Wexford Science & Technology to develop the space, which has not had a tenant since it was completed in 2018. The nearly 6,000 square feet will house a 15-barrel brew house, typical of a medium to large brew pub, that will be visible from 37th Street. The taproom entrance will be midblock, closer to Filbert Street.

The Koilors said Wexford was helping with the build-out. Besides bootstrapping the project, they have an investor and hope to obtain a loan from the PIDC.

Brewery news USA, PA: The Dead Canary Brewing Company officially opens in Philipsburg
After more than eight decades, Philipsburg again has a working, brewing brewery, StateCollege.com reported on November 5.

On Oct. 29, the doors were officially opened to the public at The Dead Canary Brewing Company.

Housed in the restored Hoffer Building at 5 N. Front St., the micro-brewery’s owners said they hope to fill a void that has been missing in town, and build a sense of community.

Head brewer Brent Baskin told Town&Gown Magazine in September that he saw first-hand what a brew pub can mean to a small community in his hometown of Perkasie in Bucks County.

“I fell in love with beer because a craft brewery opened up there. It took me a while to realize what this feeling was because there was never anything in this town that I was proud of or something that I just had to tell my friends about before — but that brewery made me want to do that. It made me excited to bring people there and show them this thing in the town I grew up in,” said Baskin.

Brewery news Canada, AB: Asymmetrical Brewing joins Edmonton’s beer scene
Asymmetrical Brewing launched in Edmonton on November 8, the Daily Hive reported.

This highly-anticipated space has been renovating its new space for over a year. Offering craft beer, craft soda, and a menu of small bites, this is an all-ages, family-friendly space that aims to be one of the best breweries in YEG.

Expect beers of all different styles, like pale ales, IPAs, sours, and more, labelled behind the super long bar. Beers like the Caramel Malted Ale and Resurrection Cream Ale sound so delicious.

It won’t be all beer, either, which makes sense because this is a family-friendly brewery and taproom. There will also be hand-crafted sodas made in-house, something super cool for YEG.


Brewery news USA, IL: Shoehorn Brewing to open in Belleville by early 2023
Shoehorn Brewing will open at 225 E. Main St. in downtown Belleville by early 2023, with homebrew shop Down the Hall Homebrew also moving in and sharing the 3,800-square-foot building with the brewery and taproom, the Sauce Magazine reported on November 7.

Co-owner Mike Johnson is an experienced homebrewer, but Shoehorn Brewing represents his first move into operating a full-time, customer-facing brewery. Johnson is opening the brewery with Jeremy Hall of Down the Hall Homebrew. Down the Hall is already open in the same 1890s-era building as Shoehorn Brewing, having relocated earlier this year from its original location at 122 E. Main St.

“The first third of the building is the homebrew store, and the back two-thirds are the taproom and brewhouse,” Johnson said. The brewery and taproom will have space for around 70 customers indoors, with a patio expected to seat an additional 50 guests.

Brewery news USA, IL: Hop Butcher for the World getting ready to launch in Chicago on November 10
A North Center brewery space that endeared itself to beer lovers for more than a decade will roar once again. The former Half Acre Beer Co. brewpub has been quiet since October 2021 as its new tenants prepared to take over. That wait is over as Hop Butcher for the World opens its doors on Thursday, November 10 at 4257 N. Lincoln Avenue, the Eater Chicago reported on November 7.

The deal was simple: Half Acre needed to downsize and Hop Butcher, which had been around since 2014, needed a space. There will be 14 beers on tap, plus coffee from Metropolis, and other non-alcoholic options, including sparkling tea.

Half Acre was a pioneering brewpub that found a niche as a neighborhood beer bar. They even had food from an accomplished chef, Nick Lacasse, who created tasty burritos and unique nachos made with “science cheese.” Hop Butcher’s Jeremiah Zimmer writes, via email, that the taproom is only for beer and drinks for now. There’s a chance to bring back food in the future, but nothing concrete.

Brewery news The Czech Republic: Budějovický Budvar joins other brewers in price hikes
November brought another increase in the price of Czech beer. Budějovický Budvar joined the producers who increased the price for a pint, it can mean two crowns more, the Prague Morning reported on November 7.

Energy prices have increased almost fourfold for the České Budějovice brewery. That is why it has increased beer prices by about ten percent since November.

“The main reason for this is energy prices and prices of packaging material, prices of hops and prices of malt in particular, we expect them to go up again by tens of percent,” described the director of Budějovický Budvar Petr Dvořák.

The price of a pint has risen by about two crowns, but in some pubs the increase may be even higher. They also plan to increase the price by other costs.

“It is electricity, gas and other things that cannot be reflected in the two crowns. Pubs have to charge more. If they can go up at all, because the loss of guests is already rapid,” said Jan Dobiáš, owner of the Zlatá Hvězda restaurant.

Even establishments that pour other beer brands into pints have had to increase their prices.

Vladimir Putin has approved a secret deal for Scotch whisky to be smuggled into Russia, amid its ongoing invasion of Ukraine, the Mirror reported on November 6.

The Kremlin boss has dodged an exports ban with the new deal that allows popular brands such as Bell’s, Johnnie Walker and Macallan across the border into Russia via a process called parallel imports.

Alternatively known as ‘the grey market’ it means goods can be supplied without the consent of the manufacturer, owner, or licence holder to get them into the former Soviet Union.

This sneaky backdoor into trading already covers around 200 big brands including Apple, Marvel, Disney Pixar and DC Comics.

But the Russian leader is now trying to get brands like Aberlour, Bowmore, Lagavulin and more onto the list, the Daily Record reports. Other products like Jägermeister, Jack Daniel’s, Jim Beam and Malibu are also being sought for import.

All were widely available in Russia until the country launched its brutal invasion of Ukraine and manufacturers announced the suspension of supplies.

Governments across the world including the UK, the US and the EU have slapped punishing sanctions on Russia and stopped or severely limited trade with the now largely pariah state.

The King of Beers is taking over Qatar, Bloomberg reported on November 7.

The signs started appearing early this year: At the Qatar Distribution Company — the only alcohol retailer in the conservative Muslim country — a massive poster with Budweiser branding featuring Lionel Messi was plastered across the entrance. Then more of Doha’s bars and restaurants started offering Budweiser on tap, a new choice in a city of Heineken draughts.

Anheuser-Busch InBev Worldwide has operated within the confines of Qatar’s strict alcohol laws for years without fanfare. Now executives are delicately seeking to maximize the return on investment of Budweiser’s World Cup sponsorship contract, in a place with where local Qatari officials came close to barring alcohol from the tournament events entirely.

Stocking up for the FIFA 2022 World Cup, which starts Nov. 20, has been a monumental undertaking for the World Cup’s official beer. The beverage brand expects more beer will be consumed during the tournament than would typically happen during an entire year in the country, according to Peter Kraemer, AB InBev’s chief supply officer.
